This thesis seeks to propose more efficient legal mechanisms to prevent the environmental catastrophes of the Antarctic marine ecosystem caused by the fishing activity. From our perspective, the main problem arises since there is no integral vision regarding the protection of the Antarctic marine species. Therefore, the detriment related to them has got a multifactorial origin. On the one hand, many species have faced a decrease in their population due to the overuse of the Antarctic marine resources and the climate change. On the other hand, these problems have not been addressed holistically by the current legal-political instruments. In this context, it is necessary to generate an understanding of the current resources management and the protection system, detecting their flaws and intend to improve the Antarctic protective mechanisms. Consequently, we consider it is necessary to propose new alternatives that match the existing international regulations law and look for more balanced values and interests at stake therefore achieving more efficient ways to preserve the different Antarctic marine species...

This title seminar analyzes the Marine and Coastal Spaces of Indigenous People (ECMPO). The ECMPO is an administrative figure of the coastal border, created by Law Nº 20.249/2008, to preserve and perpetuate ethnic ways of life and cosmovision. It starts recognizing the customary uses of the coastal zone by indigenous communities. The main objective was to analyze the law’s strengths and weaknesses, using the ECMPO located in Yaldad bay, Quellón (Chiloé Island), as a case study. A conceptual model is proposed to generate and implement administration and management plans based on the identified weaknesses. The model uses an ecosystemic, participative, and adaptive approach. The objective is to deal with the challenges of current bureaucratic lack of coordination, environmental degradation, and over-exploitation. These processes put at risk biological conservation and culture, the main objectives of the law. They can only be guaranteed through the sustainable management of ecosystem services. The model incorporates and adapts critical aspects of the coastal zone integrated management to implement in the ECMPO. The approach recognizes the importance of multiple-level social networks and the actor’s participation in solving administrative obstacles, accepting different world’ visions. The model could contribute to the generation of strategic alliances between public services and private actors to enhance local governance based on an ecosystem approach....
