El artículo presenta la posibilidad de aplicar el modelo de Estado social y democrático de derechos en Chile, con base a las normas que establece la Constitución. La hipótesis de trabajo es que es posible sin perjuicio de los déficits normativos y culturales de nuestro sistema constitucional. Asimismo, reflexiona sobre cuáles son los caracteres para reconocer el “Estado constitucional ampliado”. Así como ha señalado la Corte Interamericana de Derechos Humanos, todo sistemademocrático debe resolver una tríada inseparable: Estado de Derecho, derechos humanos y medios de garantía de estos.

The article presents the possibility of applying the model of the social and democratic State in Chile, based on standards established by the Constitution. e hypothesis is that it is possible despite the regulatory and cultural de cits of our constitutional system. Also, re ects about the characters to recognize the “expanded constitutional state”. us, as noted by the InterAmerican Court of Human Rights, any democratic system must solve an inseparable triad: the rule of law, human rights and guarantee their ways.
