La propiedad (industrial) en entredicho. Algunos elementos a tener en cuenta en materia de patentes de medicamentos

Abstract

El presente artículo busca exponer la situación normativa de las patentes sobre medicamentos, tanto en Chile como en el Derecho comparado y el sistema multilateral de la OMC. Para este fin se ha acudido a un número importante de fuentes, que ha permitido exponer el contexto en que se han verificado los cambios legislativos, como también algunos efectos que estas modificaciones han tenido en el precio de los medicamentos y las soluciones que, frente a este escenario, se han concebido para permitir conciliar los legítimos intereses del titular de la patente respectiva, con los legítimos derechos de los sujetos que padecen enfermedades y que, en conocimiento de que existen fármacos que pueden curarles o paliar los efectos negativos, no pueden acceder a ellas.

This article seeks to expose the normative situation of drug patents in Chile, as in comparative law and the WTO multilateral system. For this purpose it has been used an important number of sources, which has enabled them to present the context in which it has verified legislative changes, as some effects these changes have had on the price of drugs and solutions, that faced to this scene, are designed to enable reconcile the legitimate interests of the respective patent holder with the legitimate rights of subjects suffering from diseases, which are also in the knowledge that there are drugs that can cure or alleviate their suffering, but they cannot access those drugs.
