La permisibilidad del aborto como problema ontológico

Abstract

El artículo ofrece un argumento a favor de la irrestricta permisibilidad del aborto practicado por, o con el consentimiento de, la mujer embarazada, que descansa en la tesis de que un embrión o feto de la especie homo sapiens no exhibe –porque no puede exhibir– el estatus normativo de persona. La plausibilidad del argumento es sometida a comprobación en referencia al problema de la demarcación del aborto frente al infanticidio. Finalmente, se defiende la tesis de que, en el contexto del mismo argumento, por “aborto” no ha de entenderse la mera interrupción del embarazo, sino la producción de la muerte del embrión o feto.

The paper offers an argument in favor of the unrestricted permissibility of abortion practiced by, or with the consent of, the pregnant female, which rests upon the proposition that an embryo or fetus of the homo sapiens species does not exhibit –because it cannot exhibit– the normative status of a person. The argument’s plausibility is tested by reference to the problem of demarcating abortion from infanticide. Finally, it is claimed that, in the context of the same argument, “abortion” must be taken to mean not the bare interruption of pregnancy, but rather the killing of the embryo or fetus.
