Soberanía nacional y constitución de 1980: antecedentes de un juicio histórico-constitucional

Abstract

En este trabajo el autor argumenta sobre la base de entender que la Constitución chilena de 1980, aun con las reformas constitucionales del año 2005, no ha cambiado su carácter conservador. La Carta innovó drásticamente respecto de la tradición constitucional liberal chilena de los últimos 150 años y se atreve a desconocer la idea de soberanía que subyace a todo constitucionalismo, haciendo residir su legitimidad en principios, valores y conceptos tradicionalistas y en el “sufragio universal de los siglos” de que hace mención uno de sus principales mentores y redactores, dándole un sentido diverso a la noción de nación del que debe entender un republicanismo democrático del auténtico constitucionalismo.

In this paper the author argues on the basis of understanding that the Chilean Constitution of 1980, even with the constitutional reforms of 2005, has not changed its conservative character. The Charter drastically innovated on the Chilean liberal constitutional tradition of the past 150 years and dares to ignore the idea of sovereignty that underlies all constitutionalism, with its legitimacy reside on principles and traditional values and the “universal suffrage and ever” mention that one of his main mentors, giving a different meaning to the notion of nation must understand that genuine democratic republicanism constitutionalism.
