La regulación del terrorismo individual en la legislación chilena a la luz del modelo de estructura triádica del injusto terrorista

Abstract

El presente trabajo tiene como objetivo el análisis de la figura del terrorismo individual frente a la legislación nacional vigente y en relación a las distintas iniciativas legislativas presentadas que buscan incorporar modificaciones a la actual Ley 18.314 que determina conductas terroristas y fija su penalidad. Para entender en qué consiste el fenómeno terrorista, se realiza un estudio del modelo triádico de injusto terrorista, basado principalmente en las discusiones doctrinarias nacionales e internacionales en la materia y en la revisión de derecho comparado, analizando sus tres elementos fundamentales: estructural, instrumental y teleológico; con el objetivo de defenderlo como la propuesta argumentativa y normativa más completa a la fecha en materia de terrorismo. También se revisa, en particular, la figura del denominado “lobo solitario” y su compatibilidad con el modelo triádico adoptado. Finalmente, el trabajo contiene un excurso sobre la situación en la región de La Araucanía, en el llamado conflicto chileno-mapuche.

This paper has the purpose of analyzing different aspects of the figure of individual terrorism as stated in the current Chilean legislation, especially in the Statute 18.314, which regulates terrorism and its penalties. Since this law has been subject of many critiques and different proposals for its reform have been made, they will be compared and scrutinized. To understand what terrorism really means, this paper interprets the phenomena from a three-tiered perspective, focusing on the following elements: structural, instrumental and teleological. So far, the latter is the most comprehensive understanding of the meaning of terrorism. This paper also investigates the lone-actor terrorist and if it can fit in the three-tiered model. Finally, an excursus is included which addresses the chileno-mapuche conflict that it is currently developing in La Araucanía, in the south of Chile.
