Desafíos de la justicia restaurativa en Chile: La accesibilidad en el "Estudio Práctico" de mediación penal juvenil

Abstract

Pese los resultados beneficiosos del enfoque restaurativo, con un proceso en el cual se permite más sentimientos de participación, evidencias sugieren que la práctica queda en deuda con la teoría. Asumiendo la Justicia Restaurativa como un mecanismo de justicia, la accesibilidad aparece como un importante estándar de calidad en el servicio a la ciudadanía. Promovida por actores judiciales, ellos asumen relevancia por lograr permitir la comprensión del rol de sus creencias en el potencial desarrollo de la intervención. El “Estudio Practico” es una experiencia piloto de bases restaurativas implementada en el contexto del sistema de justicia penal juvenil en Chile, donde la presente investigación tiene como objetivo describir y analizar las condiciones bajo las cuales los procedimientos restaurativos son accesibles a los usuarios potenciales. Investigación de carácter descriptivo y exploratorio, utiliza la metodología cualitativa, mediante la aplicación de entrevistas semiestructuradas a una muestra de fiscales y defensores involucrados en el proceso de derivación. Los resultados sugieren que, si bien los profesionales reconocen los potenciales beneficios, existen desafíos en la implementación a nivel institucional, organizacional e individual que limitan la promoción de mayores espacios a las partes en la toma de decisiones, y se presentan como aprendizajes para mejorar la metodología

A B S T R A C T Despite the beneficial results of the restorative approach, in a process which more feelings of participation are allowed, evidences suggest that the practice is in debt to the theory. Assuming Restorative Justice as a mechanism of justice, the accessibility appears as an important standard of quality in the service to citizens. Promoted by judicial actors, they take on importance because they allow us to understand the role of their beliefs in the potential development of the intervention. The "Practical Study" is a pilot experience of restorative bases implemented in the context of the juvenile criminal justice system in Chile, where the present research aims to describe and analyze the conditions under which restorative procedures are accessible to potential users. Research of a descriptive and exploratory nature, using qualitative methodology, through the application of semi-structured interviews with a sample of prosecutors and public defenders involved in the referral process. The results suggest that, although professionals recognize the potential benefits, there are challenges in the implementation - at the institutional, organizational and individual levels - that limit the promotion of greater spaces for the parties in the decision making and are presented as lessons to improve the methodology
