Conflictos socio-ambientales en Chile: herramientas de tutela y democracia ambiental

Abstract

En el derecho comparado hace bastante tiempo que se aprecia la presencia de conceptos nuevos en el tratamiento de las controversias suscitadas en materia medio ambiental. Y como se verá en este trabajo, la preocupación por el medio ambiente y el entorno existe en el derecho desde hace más tiempo del que se cree. Para llegar a una acabada conclusión, el desarrollo se encarga de tratar los conflictos ambientales, concepto, causas y significación actual en Chile, así como el tratamiento jurídico que reciben en la actualidad. Se abordan las herramientas de tutela del medio ambiente que disponen las personas y las perspectivas de su participación, enfocada a conseguir el desarrollo equitativo y sustentable. Es labor de los ciudadanos, y no de los políticos, tomar en sus manos las herramientas para evitar una mayor catástrofe. Para hablar de ciudadanos en este trabajo los hemos entendido de la forma más amplia posible. Es por esto, que nos detenemos a analizar la consulta indígena separada de la participación ciudadana, pero arribando a conclusiones iguales para ambas instituciones al final de este trabajo

In comparative law, the presence of new concepts in the treatment of controversies raised in environmental matters has been appreciated for a long time. And as it will be seen in this work, the concern for the environment and the surroundings has existed in law for more time than it is believed. In order to arrive at a finished conclusion, the development is in charge of dealing with environmental conflicts, concept, causes and current significance in Chile, as well as the legal treatment they receive at present. The tools of environmental protection available to people and the perspectives of their participation are addressed, focused on achieving equitable and sustainable development. It is the work of citizens, and not of politicians, to take in their hands the tools to avoid a greater catastrophe. To talk about citizens in this work we have understood them in the broadest way possible. For this reason, we stop to analyze the indigenous consultation separated from citizen participation, but arriving at equal conclusions for both institutions at the end of this work
