Imputación y causas de justificación

Abstract

El trabajo presenta una aproximación general de la justificación en materia penal acorde a un modelo analítico del hecho punible, con un énfasis particular en la relación entre una acción justificada y las condiciones generales de la imputación. Como columna vertebral se sostiene la idea de que una acción resulta justificada solo si puede subsumirse objetivamente bajo una causa de justificación y, además, cumple con las condiciones subjetivas de imputación para ello. Diversas consecuencias se siguen de este modelo. Aquí se analizan algunas que dan claridad, por ejemplo, sobre lo que ha de entenderse por “factores subjetivos” de las causas de justificación y sobre problemas de imputación extraordinaria. Por último, se tratan en específico ciertas cuestiones relevantes en materia de las condiciones de imputación de la acción defensiva en el contexto de la legítima defensa: los casos de exceso y provocación y, al finalizar, la exigencia de no obrar impulsado por motivos ilegítimos de la legítima defensa de terceros extraños.

The work presents a general approach to justification in criminal law in keeping with an analytical model of the punishable deed, with a particular emphasis on the relationship between a justified action and the general conditions of imputation. On the basis of the argument stands the idea that an action becomes justified only if it can be subsumed objectively under a rule of justification and, furthermore, it complies with the subjective basic conditions of imputation. Various consequences arise from this model. Here are analyzed some that throw light on, for example, what has to be understood by “subjective factors” of the justifications and on problems of extraordinary imputation. Finally, this work focusing on some relevant questions concerning to the imputation conditions of the defensive action in the context of self-defense: the cases of excessive self-defense and provocation and, at last, the special requirement (not to act driven by illegitimate motives) needed by the legitimate defense of others.
