El caso del parque marino Nazca-Desventuradas: la ausencia de planes generales de administración en los parques marinos

Abstract

Durante la segunda década del siglo XXI, han sido constantes las incursiones de barcos pesqueros extranjeros, particularmente chinos, al pacífico sur y a las costas de Chile, lo que reitera la necesidad de contar con herramientas legales y de fiscalización para la conservación y preservación de los recursos y ambientes marinos del Mar de Chile. Una de esas incursiones, fue detectada por la Armada de Chile en 2020, pasando por las cercanías de las islas Desventuradas, en donde se emplaza el parque marino Nazca-Desventuradas creado en 2018. Resulta preocupante este tipo de arremetidas debido a que en los ecosistemas de las islas Desventuradas se encuentran los más altos niveles de endemismo del planeta, constituyéndose en un verdadero tesoro para todo el mundo. Con la llegada del siglo XX, se ha intensificado el paradigma de protección de los recursos económicos marinos. Durante ese siglo, el más importante logro del Derecho Internacional en la materia fue la aparición de la Zona Económica Exclusiva, enmarcada con el surgimiento de un Nuevo Derecho del Mar, en cuyo desarrollo Chile tuvo un papel trascendental. El mayor producto resultado de dicho proceso es la Convención de las Naciones Unidas sobre el Derecho del Mar, de 1982. Por ello, se hace necesario analizar las regulaciones internacionales y nacionales más importantes en la materia; y en particular el proceso que permitirá que el parque marino Nazca-Desventuradas pueda contar con su propio Plan General de Administración. Finalmente, se estimará cuál es el impacto que ha provocado en Chile este tipo de incursiones a áreas protegidas marinas. Al cierre quedan abiertas algunas importantes interrogantes como lo que será un estatuto del mar y la protección de sus recursos en una eventual nueva Constitución para Chile

During the second decade of the 21st century, there have been constant incursions by foreign fishing boats, particularly Chinese, on the South Pacific and the coasts of Chile, which resurfaces the need to have legal and control tools for the conservation and preservation of marine resources and environments of the Sea of Chile. One of these incursions, was detected by the Chilean Navy in 2020, passing through the vicinity of Islas Desventuradas, where the Nazca-Desventuradas Marine Park created in 2018 is found. This type of incursion is worrying due to the ecosystems of Islas Desventuradas have the highest levels of endemism on the planet, constituting a true treasure for the entire world. With the arrival of the 20th century, the paradigm of protection of economic marine resources has intensified. During that century, the most important achievement of International Law on the matter was the appearance of the Exclusive Economic Zone, framed with the emergence of a New Law of the Sea, in whose development Chile had a transcendental role. The greatest product resulting from this process is the United Nations Convention on the Law of the Sea, 1982. Therefore, it is necessary to analyze the most important international and national regulations on the matter; and the process that will allow the Nazca-Desventuradas marine park to have its own General Administration Plan. Finally, the impact that this type of incursions into marine protected areas has caused in Chile will be estimated. At the close, various important questions are still open, such as what will be a statute of the sea and the protection of its resources in a possible new Constitution for Chile
