La penalización de la violencia psicológica y la discriminación arbitraria cometida entre participantes de instancias deportivas competitivas nacionales

Abstract

La violencia es de los impulsos más primitivos del ser humano. Manifestada mediante distintos ámbitos – verbal, física y sicológica – ha sido causante de los más oscuros eventos históricos. No ha estado ajeno a ella el deporte; momento donde la pasión y el sentido de identidad pueden llegar a nublar el raciocinio de las personas. Por otra parte, la discriminación arbitraria es un elemento contra el cual se ha enfocado arduamente la lucha social, cultural y legal, intentando erradicarla desde todas sus aristas, teniendo en mente que tales discriminaciones vulneran los derechos más fundamentales del ser humano y han sido la causa directa de crímenes de odio, asesinatos y delitos, todo lo que lógicamente impide la instauración de una sociedad tolerante. La pregunta es si nuestra legislación es capaz al día de hoy de contrarrestar los efectos de esta violencia y discriminación, y si está encaminada hacia la erradicación de la misma, todo con propósito de salvaguardar a deportistas, espectadores y participantes en general de instancias deportivas, para no permitir que actos violentos liquiden el disfrute de una instancia tan beneficiosa como lo es el deporte. Así, haciendo un repaso por lo que involucra un evento deportivo y sus intervinientes, la presente investigación pretende realizar una recopilación y análisis económico de las leyes y decretos nacionales vigentes atingentes a la discriminación y violencia sicológica en el deporte – dejando de lado, en esta ocasión, el factor físico – situándolas en paralelo con el derecho comparado, para hallar la respuesta a la pregunta anterior y concluir qué modificaciones son necesarias o qué herramientas hacen falta para poder sostener que Chile posee una normativa efectiva para combatir la discriminación arbitraria y la violencia sicológica en el deporte

Violence is one of the most basic human impulses. It manifests itself in different spheres – verbal, physical and psychological –, and it has been the cause of some of the darkest events in human history. Sports are not an exception, as it is a moment where passion and the feeling of identity can cloud people's judgment. On the other hand, arbitrary discrimination is an issue against which social, cultural and legal fights have fiercely focused on, trying to eradicate it from all angles. This is because those discriminations violate the most fundamental human rights and have been the direct cause of hate crimes, murders and felonies, all of which obviously interfere with the building of a tolerant society. The question these days is whether our legislation is capable of countering the effects of this violence and discrimination, and whether it is headed towards the eradication of them, with the aim of keeping athletes, spectators, and participants in general of sporting events safe, so as to prevent violent acts from ruining the enjoyment of such a beneficial activity as sports. Therefore, considering everything that involves a sporting event and their participants, this investigation aims at compiling and doing an economic analysis of the current national laws and decrees concerning discrimination and psychological violence in sports–while keeping aside, on this occasion, the physical factor–aligning them with comparative law to find the answer to the previous question, and determine which modifications are necessary or what tools are missing so it can be claimed that Chile has an efficient legal system to combat arbitrary discrimination, as well as verbal and psychological violence in sports
