El mayorazgo: sus orígenes jurídicos y culturales, su evolución y su vigencia en Chile

Abstract

El presente ensayo trata del origen histórico y cultural de una institución jurídica aparentemente anacrónica: el mayorazgo, institución jurídica patriarcal formalmente derogada durante la segunda mitad del siglo XIX, pero que permanece vigente hasta la fecha mediante otras reglas jurídicas del derecho comercial. La relevancia de este trabajo radica en que con un lenguaje sencillo, el autor busca poner al servicio del debate contemporáneo acerca de las desigualdades impuestas por la cultura patriarcal heredada por la cultura judeo cristiana, un trabajo realizado con un enfoque multidisciplinario, consultando literatura no sólo jurídica, sino también de otras ciencias sociales (antropología, sociología, historia y teología, principalmente)

The present essay deals with the historical and cultural origin of an apparently anachronistic legal institution: the Mayorazgo, a patriarchal legal institution formally repealed during the second half of the 19th century, but which remains valid to date through other legal rules of commercial law. The relevance of this work lies in a simple language, the author seeks to put at the service of contemporary debate about the inequalities imposed by the patriarchal culture inherited by the Christian Judeo culture, a work done with a multidisciplinary approach, consulting literature not only legal, but also other social sciences (anthropology, sociology, history and theology, mainly)
