El rol de las municipalidades en la seguridad pública: concepto y análisis de la seguridad ciudadana

Abstract

La presente investigación tiene por objetivo analizar el rol que, actualmente, desempeñan las Municipalidades en materia de seguridad ciudadana en Chile con la regulación existente y las potestades con las que cuentan estos órganos autónomos constitucionales. Para ello, en primer lugar, habrá un capítulo introductorio con una breve revisión del origen de los municipios, los fines que persiguen y una revisión cronológica a la Ley Orgánica Constitucional de las Municipalidades en distintos momentos constitucionales de la historia de Chile. En segundo lugar, haremos un repaso al marco jurídico de la municipalidad, su concepto, características, funciones, atribuciones y potestades para así entender su ámbito de acción y los límites a éste. Asimismo, se intentará conceptualizar la seguridad ciudadana, junto con una descripción de su evolución en la historia chilena. Por último, se hará un análisis crítico sobre el creciente interés desde el poder legislativo para dotar de atribuciones a las municipalidades en materia de seguridad pública, el marco jurídico con el que cuentan actualmente, el desempeño en el desarrollo de los planes comunales de seguridad pública y los desafíos prácticos en la ejecución de estas funciones

This research aims to analyze the role that municipalities currently play on citizen security in Chile with the existing regulation and the powers that these autonomous constitutional bodies have. To do this, first of all, there will be an introductory chapter with a brief aim to review the origin of municipalities, the that pursue and a chronological review of the Constitutional Organic Law of Municipalities at different constitutional moments in Chile's history. Secondly, there will be a review of the legal framework of the municipality. Their concept, characteristics, functions, attributions and powers in order to understand its scope and the limits of it. Likewise, an attempt will be made to try conceptualize citizen security, along with a description of its evolution in Chilean history. Finally, there will be a critical analysis of the growing interest from the Legislative Power to provide the powers of municipalities in the field of public security, the legal framework they currently have, the performance in the development of communal public security plans and the practical challenges in the execution of these functions
