Limitación de responsabilidad de los prestadores de servicios de Internet por infracción a los derechos de autor en línea

Abstract

En 2010, Chile adoptó normas sobre limitación de responsabilidad a favor de los prestadores de servicio de Internet por las infracciones a los derechos de autor cometidas por sus usuarios. Este artículo describe tal régimen, resaltando ciertas medidas de observancia –identificación de infractores, terminación de servicios brindados a éstos, y bajada de contenidos– y cómo ellas se diferencian del sistema estadounidense, al incorporar control judicial a actuaciones potencialmente lesivas de los derechos de terceros.

In 2010, Chile passed regulations on the limitation of liability for internet service providers due to copyright infringement committed by their users. This article describes said regime and highlights certain observation measures –identification of offenders, termination of the services rendered to them, and removal of content– and how they differ from the American system, by including legal control to potentially harmful actions to third party rights.
