Banco Central y otras instituciones reguladoras del sistema financiero chileno

Abstract

La presente memoria pretende abordar panorámicamente el concierto regulatorio del sistema financiero en Chile, comenzando con un breve resumen de 4 enfoques regulatorios en materia financiera. Seguido de una exposición de las instituciones y normativas que atañan al sector regulado, como el Banco Central, el Ministerio de Hacienda, la Dirección de presupuestos, las Bolsas de Comercio; agregando la incorporación paulatina de un sistema semi integrado con la creación de la Comisión para el Mercado Financiero, institución pública que concentrará las facultades y atribuciones fiscalizadoras de la Superintendencia de Valores y Seguros, y la Superintendencia de Bancos e Instituciones Financieras. Los innumerables efectos de las constantes decisiones de órganos administrativos públicos y autorregulados, que interactúan en el sistema financiero hacen siempre opaco el horizonte de control sobre los actores del sector regulado, sin embargo, permiten encausar las transacciones e iniciativas de inversión de manera de supervisarla y sancionar conductas antinormativas. En un contexto de constantes cambios, la industria financiera y de seguros ha tendido a integrarse operativamente, volviendo obsoleto un modelo fiscalizador de cada industria por cuerda separada, en este sentido el derecho no puede sino reaccionar integrando sus procesos fiscalizadores haciendo converger la experiencia reguladora de 2 instituciones en un solo órgano, ahora con una perspectiva más general del fenómeno regulado.

The aim of this thesis is to approach the regulatory concert of the financial system in Chile. It presents a summary of 4 regulatory approaches in financial matters. It is then followed by a presentation of the institutions and rules that concern the regulated sector, such as the Central Bank, the Ministry of Finance, the Budget Office, the Stock Exchanges; and, of course, the gradual incorporation of a semi-integrated system with the creation of the Commission for the Financial Market. It is a public institution that will concentrate the faculties and supervisory powers of the Securities and Insurance Commission, and the Superintendency of Banks and Financial Institutions. Within the effects of constant decisions of public and self-regulated administrative bodies, which interact in the financial system, these institutions allow investment transactions and initiatives to be monitored in order to supervise and sanction antinormative behavior. Finally, there is a double movement, first from regulated subjects, and moving towards the operational integration of the financial industry and insurance. On the other hand, a tax control model for each industry, which reacts by integrating its supervisory processes, and converges the regulatory experience of 2 institutions into a single body, now with a more general perspective of the regulated phenomenon.
