Ley N° 21.057 ¿Qué estándares internacionales de protección se incorporan en ella?: una mirada de su implementación en la Región Metropolitana

Abstract

La investigación de delitos violentos y en especial de carácter sexual que afecta a niños, niñas y adolescentes se torna en ocasiones compleja, considerando que por sus características, en gran medida se carece de pruebas, indicios físicos o testigos presenciales de los hechos, lo que implica que el proceso judicial muchas veces se sostenga en su testimonio. En octubre de 2022, culminó la implementación a nivel nacional de la Ley Nº21.057, también conocida como “ley de entrevistas videograbadas”, que busca estandarizar la forma de obtención de sus testimonios y promover un trato más respetuoso y amigable en su interacción con el sistema de justicia penal. El estudio se aborda desde una metodología dogmática y cualitativa, enfocándose en los estándares internacionales de protección de los derechos humanos que resguardan la infancia y la adolescencia, y se identifican los principios adoptados por el legislador nacional en la Ley. Además, se examina cómo estos se han materializado en la práctica desde la perspectiva de los operadores del sistema, destacando su impacto positivo, pero también señalando posibles desafíos y obstáculos observados. Por otra parte, se presentan cifras y tendencias emergentes relacionadas con la implementación de la Ley en la comuna de Santiago, brindando una visión más completa de su alcance en el contexto local

The investigation of violent crimes and especially the ones of sexual nature that affect children and adolescents sometimes become complex, considering that due to their characteristics, to a large extent, there is a lack of evidence, the physical one or eyewitnesses of the facts, which implies that the judicial process is often based on their testimony. In October 2022, the nationwide implementation of Law 21,057, also known as the "law of videotaped interviews", which seeks to standardize the way to obtain their testimonies and promote a more respectful and friendly treatment in their interaction with the system of criminal justice. The study is approached from a dogmatic and qualitative methodology, focusing on international standards for the protection of human rights that protect children and adolescents, and the principles adopted by the national legislator in the Law are identified. In addition, it is examined how these they have materialized in practice from the perspective of the system operators, highlighting their positive impact, but also pointing out possible challenges and obstacles observed. On the other hand, figures and emerging trends related to the implementation of the Law in the city of Santiago are presented, providing a more complete vision of its scope in the local context
