Problemas de autoría y participación en el delito previsto en el artículo 291 del Código Penal, en el marco del Derecho Penal Empresarial

Abstract

El presente trabajo busca identificar los actuales problemas de autoría y participación que se desprenden del artículo 291 del Código Penal chileno, el denominado “delito de propagación indebida de contaminantes”, un precepto enfocado en la preservación y protección penal del medioambiente. El objetivo es describir sus características y rasgos definitorios, los bienes jurídicos que protege, la aplicación de este precepto en la práctica y los eventuales problemas que podrían surgir a la hora de responsabilizar a personas que ocupen el alto mando de una empresa, tales como ejecutivos y gerentes por delitos que cometa un trabajador

The present work seeks to identify the current problems of authorship and participation that arise from article 291 of the Chilean Penal Code, the so-called "crime of undue spread of contaminants", a precept focused on the preservation and criminal protection of the environment. An attempt will be made to describe its characteristics and defining traits, the legal assets it protects, the application of this precept in practice, and the eventual problems that could arise when it comes to holding people who occupy the high command of a company responsible, such as executives and managers for crimes committed by a worker
