Acusación constitucional: un análisis de su práctica política durante el período del estallido social

Abstract

La acusación constitucional es concebida en esta memoria como un importante mecanismo de control político, que permite fiscalizar y sancionar a autoridades que pudieran haber infringido la ley o la Constitución. Su aplicación se verifica en el caso del exministro Andrés Chadwick Piñera, cuya gestión durante el denominado “Estallido Social” (2019) fue cuestionada por la adopción de medidas para restablecer el orden público a través de las que se habrían vulnerado los derechos humanos de los ciudadanos que participaron en manifestaciones. El proceso de acusación contra Chadwick evidencia cómo este mecanismo puede debilitar la fuerza política de una coalición de gobierno, al exponer y sancionar las acciones de sus miembros más prominentes. La aprobación de la acusación marcó un hito político, destacando la capacidad del Congreso Nacional para ejercer un control efectivo sobre el Ejecutivo y sus ministros. El caso de Chadwick no solo demostró la viabilidad del mecanismo, sino también su importancia en el fortalecimiento de la democracia y la responsabilidad política en Chile

The impeachment is conceived in the investigation as an important mechanism of political control, which allows to supervise and sanction authorities who may have violated the law or the Constitution. Its application is verified in the case of ex-minister Andrés Chadwick Piñera, whose management during the so-called “Estallido Social” (2019) was questioned for the adoption of measures to restore public order through which the human rights of citizens who participated in demonstrations were allegedly violated. The impeachment process against Chadwick is evidence of how this mechanism can weaken the political strength of a governing coalition by exposing and sanctioning the actions of its most prominent members. The approval of the indictment marked a political milestone, highlighting the capacity of the Congress to exercise effective control over the Executive and its ministers. Chadwick's case not only demonstrated the viability of the mechanism, but also its importance in strengthening democracy and political accountability in Chile
