El impacto de los errores judiciales en el sistema penal: un análisis del caso de la serie The innocence files y sus implicancias en la justicia

Abstract

Esta investigación analiza los errores judiciales en el sistema penal, tomando como referencia la serie documental The Innocence Files y su conexión con el contexto chileno. La serie narra casos donde el Innocence Project exoneró a personas condenadas injustamente en Estados Unidos, destacando tres causas principales de estas condenas: uso de ciencia forense defectuosa, errores en la identificación de testigos y malas prácticas fiscales. En Chile, el Proyecto Inocentes, creado por la Defensoría Penal Pública en 2013, visibiliza errores judiciales que han afectado a miles de personas. Según cifras oficiales, más de 39,000 chilenos fueron privados de libertad y posteriormente sobreseídos o absueltos, lo que evidencia serias deficiencias en las investigaciones y procedimientos judiciales. Este proyecto busca no solo exponer estos errores, sino también promover reformas para prevenirlos y reparar el daño a las víctimas. La investigación examina el principio de presunción de inocencia, garantizado constitucionalmente en Chile, pero frecuentemente vulnerado por el uso excesivo de la prisión preventiva. Esta medida cautelar, concebida como excepcional, a menudo se convierte en una sanción anticipada, socavando los derechos fundamentales de los imputados. Casos como los de Bayron Flores y José Luis Cares ilustran cómo fallas en las investigaciones, como identificaciones erróneas y pruebas insuficientes, han llevado a inocentes a sufrir largos periodos de prisión preventiva. Aunque ambos casos concluyeron con sobreseimientos definitivos, reflejan graves deficiencias estructurales en el sistema penal. Finalmente, se analiza la acción de indemnización por error judicial, destacando los obstáculos legales y prácticos que enfrentan las víctimas para obtener compensación. Esta tesis concluye con propuestas de reformas legislativas y procesales destinadas a reducir los errores judiciales, fortalecer el sistema penal chileno y garantizar el acceso efectivo a la justicia

This research examines judicial errors in the criminal justice system, using the documentary series The Innocence Files as a reference and exploring its connection to the Chilean context. The series narrates cases in which the Innocence Project exonerated individuals wrongfully convicted in the United States, highlighting three main causes of these convictions: the use of faulty forensic science, errors in witness identification, and prosecutorial misconduct. In Chile, the Proyecto Inocentes (Innocents Project), created by the Public Defender’s Office in 2013, sheds light on judicial errors that have affected thousands of people. According to official figures, more than 39,000 Chileans were deprived of their liberty and later acquitted or had their charges dismissed, exposing serious deficiencies in investigative and judicial procedures. This project aims not only to expose these errors but also to promote reforms to prevent them and to repair the harm caused to the victims. The research examines the principle of presumption of innocence, constitutionally guaranteed in Chile but frequently undermined by the excessive use of pretrial detention. This precautionary measure, intended to be exceptional, often becomes a form of premature punishment, violating the fundamental rights of the accused. Cases such as those of Bayron Flores and José Luis Cares illustrate how investigative failures, including erroneous identifications and insufficient evidence, have led innocent individuals to endure prolonged periods of pretrial detention. Although both cases ended with definitive dismissals, they reveal significant structural deficiencies within the criminal justice system. Finally, the research analyzes the action for compensation due to judicial error, highlighting the legal and practical obstacles victims face in obtaining reparations. This thesis concludes with proposals for legislative and procedural reforms aimed at reducing judicial errors, strengthening the Chilean criminal justice system, and ensuring effective access to justice
