Ley 19.496 y cementerios parque: análisis jurisprudencial de la aplicación de la normativa de consumo en la comercialización de sepulturas

Abstract

Esta investigación tuvo como objeto determinar los principales lineamientos y tendencias de los tribunales chilenos al fallar en materias de derecho del consumidor, específicamente en las controversias suscitadas en torno a la comercialización de sepulturas por Cementerios Parques, acto de consumo regido por la Ley de Protección al Consumidor. Para ello, se consideraron sentencias pronunciadas por Tribunales Superiores de Justicia e Inferiores desde 2003 hasta 2024, incluyendo casos recientes de la Corte Suprema, con el objetivo de determinar el comportamiento jurisprudencial en el área funeraria y analizar si se justifica respecto de este postular la necesidad de regulación propia de los cementerios parque como proveedores de servicio, puntualizando si a propósito de la normativa vigente los usuarios se ven resguardados a cabalidad o si prevalece la vulnerabilidad asociada al contexto particular que rodea la contratación. El estudio abarcó 41 sentencias, seleccionadas y sistematizadas en fichas de análisis. Se estudiaron los antecedentes, la fundamentación y las reglas identificables en los fallos para entender el funcionamiento de la institucionalidad jurídica e identificar los problemas jurídicos más reiterados. Con base en este análisis, se logró categorizar los problemas en cuatro ejes temáticos: i) deberes de información del proveedor, ii) resolución por incumplimiento del contrato, iii) modificación unilateral de las condiciones y iv) vulneración de derechos fundamentales e indemnización por daño moral. El enfoque de esta memoria se centra en estas cuatro problemáticas, revisando los argumentos jurídicos utilizados por la jurisprudencia chilena en las sentencias que resuelven estas causas, analizando si se han visto influenciadas por teorías doctrinales atingentes y revisando la interacción entre las distintas áreas del derecho que coligen en esta materia

This research aimed to determine the main guidelines and trends of Chilean courts when ruling on consumer law matters, specifically, in the controversies related to the commercialization of burial plots by Park Cemeteries, a consumer act governed by the Consumer Protection Law. To this end, rulings issued by Superior and Inferior courts from 2003 to 2024 were considered, including recent rulings by the Supreme Court of Justice, with the objective of determining the jurisprudential behavior in the funeral sector and analyzing whether it justifies advocating for specific regulation of park cemeteries as service providers. This analysis also claimed to clarify whether, under current regulations, users are fully protected or if vulnerability related to the particular context surrounding the contract prevails. The study encompassed 41 rulings, which were selected and systematized in analysis files. The background, legal reasoning, and identifiable rules in the rulings were studied to understand the functioning of the legal institution and identify the most recurring legal problems. Based on this analysis, the problems were categorized into four thematic groups: i) supplier information duties, ii) contract termination for non-performance, iii) unilateral modification of terms, and iv) infringement of fundamental rights and compensation for moral damages. The focus of this dissertation centers on these four issues, reviewing the legal arguments used by Chilean jurisprudence in the rulings that resolve these cases, analyzing whether they have been influenced by relevant doctrine theories and examining the interaction between the different areas of law involved in this matter
