Marco regulatorio establecido por el sistema del Tratado Antártico para el turismo antártico: sus implicancias para la protección del medio ambiente y desafíos futuros

Abstract

Desde sus orígenes a mediados del siglo pasado, el turismo antártico se ha masificado y diversificado intensamente, consolidándose como la principal actividad multinacional y comercial en el continente austral y planteando -para cierta parte de la doctrina- la primera prueba real de la gobernanza internacional del Sistema del Tratado Antártico. El presente trabajo pretende dilucidar si el marco jurídico actual dentro del Sistema del Tratado Antártico resulta suficiente para regular apropiadamente al turismo antártico, proteger eficazmente al medioambiente y sus ecosistemas dependientes y asociados, y enfrentar los nuevos desafíos a futuro. Para ello, se recopila y analiza la regulación establecida por los instrumentos, y principalmente, por los foros del Sistema del Tratado Antártico, junto con la proveniente de otros actores externos, como la Asociación Internacional de Operadores Turísticos de la Antártica. Igualmente, se desarrollan en profundidad dos desafíos actuales planteados a la regulación del turismo antártico: la articulación de un marco coherente e integrado de regulación y la aplicación de la Evaluación de Impacto Ambiental para las actividades turísticas y no gubernamentales en la Antártica. De la investigación realizada, se concluye que -pese a los esfuerzos de las Partes Consultivas del Tratado Antártico- al momento no se ha logrado un consenso político respecto un marco regulatorio coherente e integrado sobre el turismo antártico, lo cual ha significado que la regulación presente un carácter fragmentario, ad-hoc, reactivo y exhortatorio. En dicho panorama, la aproximación actual para la protección del medioambiente antártico ha provenido, en la práctica, de herramientas de gestión territoriales y de la autorregulación del sector turístico

Since its origins in the middle of the last century, Antarctic tourism has intensively massified and diversified, consolidating itself as the main multinational and commercial activity on the southern continent and posing -for some of the doctrine- the first real test of the international governance of the Antarctic Treaty System. This paper aims to elucidate whether the current legal framework within the Antarctic Treaty System is sufficient to properly regulate antarctic tourism, to effectively protect the environment and its dependent and associated ecosystems, and to face the new challenges ahead. To this end, the regulation established by the instruments, and mainly by the Antarctic Treaty System fora, is compiled and analyzed, together with that coming from other external actors, such as the International Association of Antarctic Tour Operators. Likewise, two current challenges posed to the regulation of Antarctic tourism are developed in depth: the articulation of a coherent and integrated regulatory framework and the application of the Environmental Impact Assessment for tourism and non-governmental activities in Antarctica. From the research carried out, it is concluded that -despite the efforts of the Antarctic Treaty Consultative Parties- no political consensus has been reached so far regarding a coherent and integrated regulatory framework for Antarctic tourism, which has meant that regulation is fragmentary, ad-hoc, reactive and exhortatory in nature. In this scenario, the current approach to the protection of the Antarctic environment has come, in practice, from territorial management tools and the self-regulation of the tourism sector
