Immigrants in Chile are concentrated in a few regions and municipalities. Most of them live in segregated areas and highly vulnerable neighborhoods. Using data from the year 2019, and controlling for fixed effects at the school level, we seek to evaluate the impacts of the concentration of immigrants on the performance of native Chilean students. Negative effects are found for natives and foreigners in the SIMCE math tests for eighth grade. These effects are reduced when controlling for characteristics of the school, or the student, but they are still negative and significant. Heterogeneous results are found, which confirms that the impact of immigration is different depending on the geographical region or the socioeconomic level. It is relevant to evaluate the segregation and concentration that immigrants face in the Chilean school system in order to focus public policy on avoiding additional attention towards a disadvantaged group, since it brings a negative effect not only for them but also for local students...

Migración internacional y política migratoria en Chile : tensiones entre la soberanía estatal y las ciudadanías emergentes

Objective/Context: International migrations open the debate on citizenship, inclusion, and human rights, as well as sovereignty, national security, and selectivity. Chile is not oblivious to these tensions, challenges, and opportunities. Addressing the period from the 1990s to the present day, we analyze international migration narratives and how they are expressed by the country’s Department of Foreign Affairs and Migration. Methodology: We use a qualitative method and case study to examine the historical and political factors in depth. Similarly, the historical analysis we include shows the continuities and changes in international migration’s conceptualization and laws. Conclusions: There is a struggle to define the national/international limits that permeates the discussions on citizenship and international migration. Likewise, visions focused on national security compete against others focused on rights. We believe that after the social outbreak in Chile, there is a new structure of political and social opportunities to discuss a migration law and a Constitution that addresses the rights of migrants, rules of due process, mechanisms for social and political participation. Originality: This article discusses the recognition and representation of emerging citizenship, a fundamental theme in the increasingly numerous multicultural societies of the 21st century. Likewise, an international and political perspective, rarely used in migration studies, particularly in Chile, is included....

The following essay describes and examines the different legal norms and dispositions contained in international instruments related to the right to education; such as The Universal Declaration of Human Rights; The Convention on the Rights of the Child; International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families; and two reports from the Office of the United Nations High Commissioner for Human Rights among others in order to identify the current international standards of protection that must be implemented in Chile. The aforementioned analysis has allowed us to identify the existence of international standards of protection that have been systematized into the 4 As scheme (availability, accessibility, acceptability, adaptability) and that establish concrete obligations that governments must abide by in respect to the right to education. Finally, after the revision of the Migration and Foreigners Law 21.325, the ordinary office N°894, from 2016 and the Political Constitution articles 5 and 19 N°10, we are in a position to determine if the previous norms comply adequately with the international standard of protection referred to the right to education, besides analyzing what happens in reality with this right. This work finishes with a reference to the good practices and recommendations that can be followed in order to establish an effective protection and compliance to immigrant minors' right to education in both regular and irregular legal status in Chile, besides being implemented...
