Génesis y desarrollo de la objeción de conciencia sanitaria en Chile desde una perspectiva filosófica, jurídica y bioética

Abstract

La objeción de conciencia es un concepto sensible y complejo de abordar, pues contempla variadas consecuencias prácticas de suma importancia, principalmente en el contexto sanitario. Pese a su gran relevancia, hoy es un término ambiguo, del cual no ha sido regulado cabalmente -confundiéndose incluso con otras instituciones a fines- ni menos ha existido un acabado tratamiento doctrinal sobre la materia, sobre todo en lo que respecta su apreciación filosófica, jurídica y bioética a fin de ser aplicada en el campo sanitario. A lo anterior, se suma la actual significación y extensión que se le ha realizado al término en torno a la actual ley que reforma el Código Sanitario y que establece la despenalización de la interrupción voluntaria del embarazo en tres causales, la que, mediante un extenso debate legislativo y constitucional, ha promovido nuevos aspectos de lo que se entiende a la aplicación práctica objeción de conciencia en el ámbito sanitario, referida para un caso concreto, pero de la cual no necesariamente se puede extrapolar o aplicar a otras problemáticas que surjan en el campo sanitario. Identificada dicha problemática, la presente investigación consistirá en un análisis filosófico, jurídico y bioético sobre la objeción de conciencia, su extensión y efectos, intentando revalorizar el sentido del concepto, y cómo éste puede adentrarnos en la discusión actual a la luz de nuestro contexto sanitario. Para ello exploraremos en el origen y desarrollo de la objeción de conciencia sanitaria en Chile, a partir del concepto de conciencia moral y libertad de conciencia según Kant, Kohlberg y Mill, reflexionando además sobre las principales consecuencias éticas en el ámbito sanitario, con el objetivo de aproximarnos hacia la comprensión y análisis del significado de la objeción de conciencia sanitaria principalmente en el contexto chileno.

Conscientious objection is a sensitive and complex concept that contemplates important and practical consequences, mainly in the sanitary context. Despite its great relevance, today is an ambiguous term, which has not been fully regulated and has been confused even with other terms, especially in regard to their philosophical, legal and bioethics appreciation in order to be applied in the sanitary field. By this, the current significance and extension of the term, we will analyze the actual law that reforms the Chilean Health Code and that establishes the decriminalization of the voluntary interruption of pregnancy in three causes, which, by means of an extensive legislative and constitutional debate, has promoted new aspects of what is meant by the practical application of sanitary conscientious objection, referred to a specific case, but from which it can not necessarily be extrapolated or applied to other problems that arise in the sanitary field. Once this problem is identified, the present investigation will consist of a philosophical, legal and bioethical analysis about conscientious objection, its extension and effects, trying to revalue the meaning of the concept, and how it can enter into the current discussion in the sanitary context. Then, we will explore the origin and development of the sanitary conscientious objection in Chile, based on the concept consciousness and freedom of conscience according to Kant, Kohlberg and Mill, also reflecting on the main ethical consequences in the sanitary field, with the objective to approach the understanding and analysis of the meaning of health awareness objection mainly in the Chilean context.
