El Tratado Integral y Progresista de Asociación Transpacífico - CTPP y sus efectos en las empresas públicas Chilenas

Abstract

El Tratado Integral y Progresista de Asociación Transpacífico – CTPP o TPP-11 se encuentra en la última fase de ratificación por parte de Chile, sin embargo se han levantado interrogantes sobre cómo afecta este acuerdo a las empresas públicas, en este sentido la hipótesis que guía la investigación radica en los posibles efectos en la capacidad del Estado de ejercer acciones en torno a las condiciones de competitividad de las empresas públicas chilenas. Para lo anterior se realizó una investigación de tipo descriptiva analizando, en primer lugar, las características de las empresas públicas chilenas y su clasificación para su posterior análisis, en segundo lugar, se revisó la totalidad de los capítulos que conforman el TPP-11 a fin de determinar la forma en que podrían afectar a las empresas públicas. Con posterioridad, se ahondó en los capítulos que aportaron en el análisis de la investigación siendo estos el capítulo 17 de empresas públicas y el capítulo 28 de Solución de Controversias. A continuación, se realizó una clasificación de las empresas públicas chilenas según su sujeción a los criterios de excepción descritos en TPP-11, lo cual se complementó con la opinión de expertos en la materia, a fin de contrastar perspectivas en torno al posible efecto del Acuerdo. Finalmente, luego del análisis de la información recolectada y su comparación con la opinión de los expertos entrevistados se refutó la idea en torno a los posibles efectos del tratado en las empresas públicas chilenas.

The Comprehensive and Progressive Treaty of Trans-Pacific Partnership - CTPP or TPP-11 is in the last phase of ratification by Chile, however, questions have been raised about how this agreement affects State-Owned Enterprises, in this sense the hypothesis that guides the investigation is based on the possible effects on the State's capacity to take actions regarding the competitiveness conditions of Chilean State Owned Enterprises. For the above, a descriptive research was carried out, first analyzing the characteristics of Chilean State-Owned Enterprises and their classification for subsequent analysis, secondly, all the chapters that make up the TPP-11 were reviewed in order to determine the way they could affect public companies. Subsequently, they delved into the chapters that they contributed to the analysis of the investigation, these being Chapter 17 of State-Owned Enterprises and Chapter 28 of Dispute Resolution. Next, a classification of the Chilean public enterprises was made according to their subjection to the exception criteria described in TPP-11, which was complemented with the opinion of experts in the field, in order to contrast perspectives on the possible effect of the Agreement. Finally, after analyzing the information collected and comparing it with the opinion of the experts interviewed, the idea regarding the possible effects of the treaty on Chilean State-Owned Enterprises was refuted.
