La contribución de las Joint Statement Initiatives (JSIs) en el sistema multilateral de comercio

Abstract

A raíz del surgimiento de los procesos plurilaterales denominados Joint Statement Initiatives en la 11° Conferencia Ministerial de la OMC, se ha instalado una discusión respecto a la legitimidad legal y su contribución en el sistema multilateral de comercio. Estos procesos han proporcionado mayor flexibilidad a las discusiones dentro de la OMC, revitalizando el pilar de negociaciones dentro de la organización, mediante la inclusión de nuevos temas de relevancia para el comercio internacional y respetando los principios básicos del sistema multilateral de comercio. Además, constituyen una vía para volver a instalar la creación de reglas comerciales globales al interior de la OMC, y así evitar que estas continúen desarrollándose mediante acuerdos comerciales regionales. En el capítulo 1, se analiza el rol que han tenido los acuerdos plurilaterales en la construcción del sistema multilateral de comercio, desde su creación con el GATT de 1947 hasta la actualidad. En el capítulo 2, se explora sobre los fundamentos de las JSIs en el contexto de la OMC, incluyendo las razones de su surgimiento, las características de cada una de ellas, y sus elementos comunes. Por último, en el capítulo 3, se analizan las alternativas con base a las actuales reglas de la OMC para incorporar sus resultados en el acervo legal de la OMC y su contribución en el sistema multilateral de comercio. Finalmente, destacar que en el contexto de la reforma de la OMC, el fortalecimiento del pilar en materia de negociaciones constituye un elemento central, por lo que la discusión en torno a los acuerdos plurilaterales y las JSIs ocupará un lugar destacado en la agenda multilateral en los próximos años.

As a result of the emergence of the plurilateral processes called Joint Statement Initiatives (JSIs) at the 11th Ministerial Conference of the WTO, a discussion regarding legal legitimacy and its contribution to the multilateral trading system has been installed. These processes have provided greater flexibility to the discussions within the WTO, revitalizing the pillar of negotiations within the organization, by including new issues of relevance to international trade and respecting the basic principles of the multilateral trading system. In addition, they constitute a way to reinstall the creation of global trade rules within the WTO, and thus prevent these from continuing to be developed through regional trade agreements. Chapter 1 analyzes the role that plurilateral agreements have played in the construction of the multilateral trading system, from its creation with the GATT of 1947 to the present. Chapter 2 explores the foundations of the JSIs in the context of the WTO, including the reasons for their emergence, the characteristics of each of them, and their common elements. Finally, in chapter 3, the alternatives are analyzed based on the current WTO rules to incorporate their results into the legal architecture of the WTO and their contribution to the multilateral trading system. Finally, it should be noted that in the context of the WTO reform, the strengthening of the negotiating pillar is a central element, so the discussion around plurilateral agreements and JSIs will occupy a prominent place on the multilateral agenda in the coming years.
