El derecho a salud mental de las personas migrantes en Chile: ¿existe un marco normativo que regule las prestaciones psicológicas para personas migrantes?

Abstract

Este ensayo tiene como propósito conocer las obligaciones jurídicas del Estado chileno en materia de salud mental, de modo a permitir el efectivo acceso a servicios y prestaciones médicas a las personas migrantes en Chile. Para esto se realiza un análisis de la normativa nacional e internacional vigente, y los principios jurídicos que comprenden el acceso al derecho a salud con un enfoque en salud mental. Posteriormente se identifican los principales jurídicos que impiden o dificultan una adecuada atención de estas personas. Y finalmente se plantearán los desafíos pendientes que tiene nuestro país en esta materia acorde a los parámetros establecidos por entes internacionales

The purpose of the essay is to know the legal obligations of the Chilean State in terms of mental health, in order to allow effective access to medical services and benefits for migrants in Chile. For this, an analysis of the current national and international regulations is carried out, and the legal principles that integrate access to the right to health with a mental health approach. Subsequently, the main legal aspects that prevent or hinder adequate care for these people are identified. And finally, the pending challenges that our country has in this matter will be considered according to the parameters established by international organizations
