El concepto normativo de acoso escolar a partir de la Ley N° 20.536: análisis crítico y comparado

Abstract

La presente investigación, en primer lugar, para un adecuado tratamiento de las materias posteriores, comienza por distinguir las diferencias y relaciones que existen entre el conflicto, la violencia y el acoso escolar. Luego, analiza el concepto normativo de acoso escolar, primero en el Derecho comparado (a saber, los EE. UU. y España), y después en Chile. A continuación, se examinan los elementos más relevantes de la definición legal del artículo 16 letra b), que introdujo la ley n° 20.536 el año 2011. Por último, se constata la manera en que el acoso escolar infringe múltiples normas del Derecho interno

The present Inquiry, first, and in order to achieve an adequate treatment of the subsequent subjects, begins by establishing the differences and links that exist between school conflict, school violence, and Bullying or student Harassment. Then, it analyses the legal concept of Bullying, starting with the Comparative Law Systems (i.e, the USA and Spain), and afterwards, in Chile. It continues next with the study of the core components or elements of Bullying behavior, according to the newest legal definition, provided by Article 16, letter b), of law n° 20.536, of 2011. Lastly, the way in which Bullying breaches multiple rules of Chilean national Law is demonstrated
