Visas humanitarias en América Latina y el Caribe: criterios de vulnerabilidad

Abstract

Las visas humanitarias se han consolidado como un mecanismo clave para la protección de los migrantes en situación de vulnerabilidad en América Latina y el Caribe. Aunque estos migrantes no son formalmente reconocidos como refugiados, requieren atención especial debido a su alto nivel de riesgo. Este estudio se centra en analizar los criterios de vulnerabilidad que los Estados de la región utilizan para conceder visas humanitarias. A través de un análisis cualitativo comparado, la investigación se organiza en tres capítulos principales. El primer capítulo se enfoca en los instrumentos alternativos al asilo, resaltando el marco normativo en el que se desarrolla el debate sobre las visas humanitarias. El segundo capítulo examina los programas de visas humanitarias en la región, con especial atención a su estructura y aplicación. El tercer capítulo se dedica al análisis de los criterios de vulnerabilidad reconocidos por estos programas, destacando su importancia dentro del marco de protección internacional de los migrantes en situación de vulnerabilidad.

Humanitarian visas have emerged as a key mechanism for the protection of migrants in vulnerable situations in Latin America and the Caribbean. Although these migrants are not formally recognized as refugees, they require special attention due to their high level of risk. This study focuses on analyzing the vulnerability criteria that States in the region use in granting humanitarian visas. Through a comparative qualitative analysis, the research is organized into three main chapters. The first chapter focuses on alternative instruments to asylum, highlighting the normative framework in which the debate on humanitarian visas takes place. The second chapter examines the humanitarian visa programs in the region, with special attention to their structure and application. The third chapter is dedicated to analyzing the vulnerability criteria recognized by these programs, emphasizing their importance within the international protection framework for migrants in vulnerable situations.
