Pacto para el futuro: avances hacia la regulación de la inteligencia artificial (IA) en el marco del pacto digital mundial

Abstract

La presente investigación aborda la regulación de la inteligencia artificial (IA) en el ámbito global. En ese contexto, el “Pacto Digital Mundial” surge como una iniciativa internacional para desarrollar principios y normas comunes para la gobernanza digital, incluida la IA. Esta investigación, mediante una metodología de estudio descriptivo de carácter cualitativo, con apoyo en información cuantitativa de revisión documental, analiza los avances en el proceso negociador de la regulación de la Inteligencia Artificial en el marco del Pacto Digital Mundial que se inserta en el ámbito del PACTO PARA EL FUTURO, destacando los principales posicionamientos en materia de gobernanza global de la IA. En este sentido, se estudian las contribuciones realizadas por diversas entidades y actores en torno a las consultas en línea abiertas, entre junio de 2022 a abril de 2023, en el sitio web de Naciones Unidas. Los resultados evidencian progresos, pero también divergencias entre los actores sobre cómo lograr un modelo de gobernanza global de la IA. Por lo cual, el primer capítulo ofrece una introducción a la IA, donde se examinan su caracterización, evolución y aplicaciones, y se analiza cómo estos aspectos están conectados con la cooperación digital a nivel global, resaltando la gobernanza digital mundial como un elemento fundamental; el segundo capítulo se centra en el “PACTO PARA EL FUTURO”, investigando las propuestas y los progresos hacia un pacto que determinará la futura interacción entre tecnología, regulación y cómo las cumbres y debates internacionales están influenciando la formación de dicho pacto. En el tercer capítulo, se aborda el “Pacto Digital Mundial”, explorando sus fundamentos, el proceso de negociación y las contribuciones de diversos actores globales, subrayando la relevancia de la cooperación tecnológica y la innovación. El cuarto capítulo, se enfoca en las propuestas de regulación de la IA, presentando contribuciones hacia un modelo de gobernanza global que incorpore los avances en la negociación internacional y brinde soluciones a los desafíos regulatorios que presenta la IA.

This research addresses the regulation of artificial intelligence (AI) at the global level. In this context, the “Global Digital Compact” emerges as an international initiative to develop common principles and standards for digital governance, including AI. This research, through a descriptive study methodology of qualitative nature, supported by quantitative information from documentary review, analyzes the progress in the negotiating process of the regulation of Artificial Intelligence in the framework of the Global Digital Compact that is inserted in the scope of the Pact for the Future, highlighting the main positions on global governance of AI. In this regard, we study the contributions made by various entities and actors around the open online consultations, between June 2022 and April 2023, on the United Nations website. The results show progress, but also divergences among actors on how to achieve a global governance model for AI. Therefore, the first chapter provides an introduction to AI, examining its characterization, evolution and applications, and analyzes how these aspects are connected to global digital cooperation, highlighting global digital governance as a fundamental element; the second chapter focuses on the “Compact of the Future”, investigating the proposals and progress towards a compact that will determine the future interaction between technology, regulation and how international summits and debates are influencing the formation of such a compact. In the third chapter, the “Global Digital Compact” is addressed, exploring its foundations, the negotiation process and the contributions of various global actors, highlighting the relevance of technological cooperation and innovation. The fourth chapter focuses on proposals for AI regulation, presenting contributions towards a global governance model that incorporates the advances in international negotiation and provides solutions to the regulatory challenges presented by AI.
