El acceso a la justicia de las mujeres víctimas de violencia en Chile: soluciones y deudas

Abstract

La presente investigación, tiene como objetivo principal dar conocer la legislación nacional e internacional sobre el acceso a la justicia en específico con perspectiva de género, en atención a los constantes casos de violencia que son víctimas y su consideración como un grupo vulnerable. Podrá observar normativa internacional, tales como: Convención Americana sobre Derechos Humanos, Declaración Americana de los Derechos y Deberes del Hombre, la Convención Interamericana para Prevenir, Sancionar y Erradicar la Violencia Contra la Mujer y la Convención de Belém do Pará. Desde una visión nacional, podrá revisar la ley 20.066, el delito de femicidio en la ley 20.480, Resolución AD-566-2016 de Secretaría Técnica de Igualdad de Género y no Discriminación, la ley 21.675 y la ley 21.643. En virtud de los reiterados hechos de violencia de género existentes en Chile, se ha trabajado en implementar en el escenario público los fundamentos e importancia del acceso a la justicia para ellas, con normativa específica, instituciones de protección y otros, que buscan disminuir la violencia. La metodología utilizada combina un enfoque documental, descriptivo y explicativo. Se recopila información a partir de libros, artículos científicos, sitios web, doctrina, estadísticas y normativa específica del asunto. Se busca evidenciar a través del estudio e investigación la realidad que enfrentan las mujeres chilenas en torno al acceso a la justicia, cuando son víctimas de violencia

The main objective of this research is to raise awareness of national and international legislation on access to justice, specifically from a gender perspective, in light of the constant cases of violence that women are victims of and their consideration as a vulnerable group. You will be able to observe international regulations, such as: American Convention on Human Rights, American Declaration of the Rights and Duties of Man, the Inter-American Convention to Prevent, Punish and Eradicate Violence Against Women and the Convention of Belém do Pará. From a national perspective, you will be able to review Law 20,066, the crime of femicide in Law 20,480, Resolution AD-566-2016 of the Technical Secretariat for Gender Equality and Non-Discrimination, Law 21,675 and Law 21,643. Due to the repeated acts of gender violence in Chile, work has been done to implement in the public arena the foundations and importance of access to justice for them, with specific regulations, protection institutions and others, which seek to reduce violence. The methodology used combines a documentary, descriptive and explanatory approach. Information is collected from books, scientific articles, websites, doctrine, statistics and specific regulations on the subject. The aim is to demonstrate through study and research the reality that Chilean women face in terms of access to justice when they are victims of violence
