Derecho de participación de niños, niñas y adolescentes migrantes en Chile: un desafío de la institucionalidad pública en la toma de decisiones

Abstract

La presente investigación aborda el derecho de participación de niños, niñas y adolescentes migrantes en Chile, haciendo hincapié a los esfuerzos y desafíos institucionales públicos para la inclusión de ellos(as) en la toma de decisiones. El contexto de la investigación se sitúa en el crecimiento de población migrante, donde se enfatiza la importancia de generar acciones que incluyan particularmente a la niñez y adolescencia, en línea con la Convención de los Derechos del Niño. El análisis considera tanto el marco normativo chileno, como la comparación de otras iniciativas de países de la zona. Cabe señalar que Chile ha avanzado en propuestas, tales como son los Diálogos Participativos, los cuales incluyen la opinión del sector mencionado. Sin embargo, resulta crucial estudiar cuáles son los obstáculos y oportunidades que se evidencian para generar acciones reales en la materia. La metodología del presente informe es cualitativa, basado en la búsqueda de bibliografía y entrevistas a actores claves. Finalmente, el estudio concluye con recomendaciones y hallazgos pertinentes para fortalecer la inclusión de ese sector, promoviendo un enfoque intercultural y equitativo, para que así, el Derecho a la Participación esté establecido en cada acción y toma de decisión política. Abstract This research addresses the right to participation of migrant children in Chile, emphasizing public institutional efforts and challenges for their inclusion in decision-making. The context of the research is situated in the growing migrant population, where the importance of generating actions that particularly include children is emphasized, in line with the Convention on the Rights of the Child. The analysis considers both the Chilean regulatory framework and the comparison of other initiatives in other countries in the region. It should be noted that Chile has advanced in proposals, such as the Participatory Dialogues, which include the opinion of the mentioned sector. However, it is crucial to study the obstacles and opportunities that are clear to generate real actions in this area. The method of this report is qualitative, based on a literature search and interviews with key actors. Finally, the study concludes with recommendations and pertinent findings to strengthen the inclusion of this sector, promoting an intercultural and fair approach, the Right to Participation is set up in every action and political decision making.
