El acuerdo de residencia Mercosur: la aplicación del acuerdo a los migrantes colombianos en Chile

Abstract

Esta tesis investiga la aplicación del Acuerdo de Residencia MERCOSUR en Chile (1990-2023) enfocándose en los migrantes colombianos. Analiza la evolución de la migración colombiana a Chile, destacando factores motivacionales, así como las implicaciones socioeconómicas y demográficas. Se explica el génesis del Acuerdo de Residencia MERCOSUR así como diferentes flujos migratorios de países miembros y asociados hacia Chile. Asimismo, se profundiza en la internalización del Acuerdo en Chile, señalando un enfoque restrictivo hacia migrantes de países asociados como Colombia. La investigación hace uso de un enfoque mixto arrojando que pese a los esfuerzos por modernizar la política migratoria con la Ley 21.325, Chile mantiene restrictiva la aplicación del Acuerdo al hacer uso del oficio circular n 24.465 de 04/12/2009, el cual excluye de su aplicación a nacionales de Colombia, medida que no solo contraviene el propio acuerdo, sino que también evidencia la limitada cobertura de la nueva legislación migratoria chilena.

This thesis investigates the application of the MERCOSUR Residency Agreement in Chile (1990-2023) focusing on Colombian migrants. It analyzes the evolution of Colombian migration to Chile, highlighting motivational factors, as well as socioeconomic and demographic implications. It explains the genesis of the MERCOSUR Residence Agreement as well as different migratory flows from member and associate countries to Chile. Likewise, the internalization of the Agreement in Chile is studied, pointing out a restrictive approach towards migrants from associated countries such as Colombia. The research makes use of a mixed approach showing that despite the efforts to modernize the migration policy with Law 21.325, Chile keeps the application of the Agreement restrictive by using circular letter n 24.465 of 04/12/2009, which excludes Colombian nationals from its application, a measure that not only contravenes the agreement itself, but also evidences the limited coverage of the new Chilean migration legislation.
