El alza en el nivel del mar en los océanos: lineamientos analizados en la comisión del derecho internacional (CDI) con relación a las líneas de base de los países ribereños afectados por el cambio climático

Abstract

Esta Investigación tiene como objetivo desarrollar la relación entre el cambio climático y el Derecho del Mar, enfocándose en cómo la elevación del nivel del mar afecta a los Estados ribereños y sus respectivas costas. De acuerdo a la Convención de Naciones Unidas sobre el Derecho del Mar (CONVEMAR), los espacios marítimos son definidos desde las líneas de base de cada Estado ribereño, por tanto, esta investigación busca comprender las implicancias jurídicas que este fenómeno podría tener sobre la soberanía de los Estados ribereños y su capacidad para mantener control sobre sus espacios marítimos en el corto y largo plazo, dependiendo de avance del aumento del nivel del mar. El eje central de la investigación gira en torno al trabajo de diferentes actores del Derecho Internacional, como lo son la International Law Association (ILA), y las Naciones Unidas, mediante la Asamblea General de las Naciones Unidas, y su Sexta Comisión (Legal), la cual encomendó a la Comisión de Derecho Internacional (CDI) el análisis jurídico de dichas implicancias a nivel de derecho. Conceptos jurídicos como “la tierra domina al mar”, la “equidad”, la “estabilidad jurídica”, el “congelamiento de las líneas de base” y el “mantenimiento de la condición de Estado” son abarcados en esta investigación, sobre todo por la opinión en derecho de miembros de la ILA (no estatales) y de la CDI (por medio de sus grupos de trabajo), los que son luego debatidos por los Estados en la Sexta Comisión (Legal). Finalmente, la investigación incluye entrevistas y análisis de posturas jurídicas y científicas de quienes investigan y trabajan actualmente en Chile sobre el tema, lo cual permite ofrecer una visión amplia sobre cómo Chile y otros países afectados están abordando este desafío global, y qué opciones tiene Chile para proteger intereses marítimos en un contexto de incertidumbre climática.

This research aims to explore the relationship between climate change and the Law of the Sea, focusing on how rising sea levels impact coastal States and their respective shores. According to the United Nations Convention on the Law of the Sea (UNCLOS), maritime zones are defined from the baselines of each coastal State. Therefore, this research seeks to understand the legal implications that this phenomenon could have on the sovereignty of coastal States and their ability to maintain control over their maritime zones in the short and long term, depending on the progression of sea level rise. The central axis of the research revolves around the work of various actors in International Law, such as the International Law Association (ILA), and the United Nations, through the United Nations General Assembly and its Sixth Committee (Legal), which entrusted the International Law Commission (ILC) with the legal analysis of these implications at the legal level. Legal concepts such as "land dominates the sea," "equity," "legal stability," "freezing baselines," and the "maintenance of statehood" are addressed in this research, especially through the legal opinions of ILA (non-state) members and the ILC (via its working groups), which are then debated by States in the Sixth Committee (Legal). Finally, the research includes interviews and analysis of the legal and scientific positions of those currently investigating and working on this issue in Chile, providing a broad perspective on how Chile and other affected countries are addressing this global challenge, and what options Chile has to protect its maritime interests in a context of climate uncertainty.
