Reforma de la política: Una mirada sistémica
Abstract
Las próximas elecciones parlamentarias se darán bajo un sistema regulatorio completamente distinto. Al
sistema de voto voluntario e inscripción automática, se suma un nuevo sistema electoral y, de aprobarse los
proyectos de ley en discusión, habrá nuevos mecanismos de financiamiento de campañas electorales y
partidos políticos. Además, se cambiará la manera cómo se estructuran internamente los partidos políticos y,
posiblemente, se otorguen mayores capacidades al órgano fiscalizador y sancionador.
Los cambios descritos son una transformación gigantesca y deben pensarse como un todo, evaluando cómo
interactúan entre sí para evitar el riesgo de la incoherencia legislativa. El objeto de este texto es aportar una
mirada sistémica a las reformas que se han llevado y se están llevando a cabo: sistema electoral, partidos
políticos, financiamiento de la política (campañas electorales y partidos), órganos fiscalizadores y
sancionatorios.
Como punto de partida, señalamos ciertos principios que debieran informar la regulación de la política.
Primero, el sistema electoral del Congreso debe adecuarse al presidencialismo. Segundo, respecto de los
partidos políticos, aunque son fundamentales para la democracia representativa y deben recibir
financiamiento fiscal y privado, no se debe fomentar demasiado el multipartidismo. Tercero, las elecciones
deben tener un financiamiento mixto, con un piso fiscal y un aporte privado que fomente la competencia, a
través de un mecanismo que evite el cohecho y la extorsión. Cuarto, el Servel debe contar con facultades
fiscalizadoras y sancionatorias realistas, sin que sea necesario otorgarle autonomía constitucional, y pensadas
en conjunto a la regulación del Tricel.
El nuevo sistema electoral proporcional moderado debe ser la base para analizar el resto de los cambios
propuestos. Por ejemplo, la posibilidad de una mayor fragmentación del Congreso que trae consigo puede
acelerarse por el hecho de haber rebajado los límites para constituir partidos, especialmente dado que se les
otorgará aportes fiscales.
Respecto del financiamiento electoral, debe evitarse que el nuevo sistema propuesto cargue la balanza
excesivamente a favor del aporte estatal, favoreciendo así a los congresistas que buscan reelegirse. Además,
es crucial evaluar los nuevos límites de gasto electoral considerando que, bajo el nuevo sistema electoral, los
distritos y circunscripciones crecieron en extensión territorial, lo que puede afectar a los desafiantes, que
deben darse a conocer en un sistema electoral que aumenta también la cantidad de candidatos. Respecto de
las campañas, si bien extender el período de campaña es un avance positivo, debe cuidarse que la definición
tanto de propaganda electoral como de gasto electoral no implique restricciones desmedidas a la libertad de
expresión.
Actualmente está en discusión una nueva ley de partidos políticos. Si bien la reforma apunta en el sentido
correcto, la ley debe resguardar la necesaria autonomía de los partidos. Es importante que esta reforma se
analice conjuntamente con el proyecto de ley que le otorga financiamiento fiscal permanente a los partidos.
El aporte estatal es una buena noticia siempre que dichos fondos sean verdaderamente condicionales al
desarrollo de actividades que reconecten a la ciudadanía con los partidos. El financiamiento privado a favor
de los partidos, a través de donaciones pequeñas y del pago de cuotas, debiera promoverse, para acercarlos
a la ciudadanía.
