Mejoramiento genético vegetal y propiedad intelectual en Chile : de variedades públicas a variedades privadas

Abstract

El mejoramiento genético vegetal o fitomejoramiento es una disciplina que busca la obtención de variedades vegetales que posean características específicas, interesantes a nivel agronómico y comercial. Esta disciplina tiene sus bases en la domesticación de especies, es decir, en técnicas gestadas hace más de 10.000 años en los primeros asentamientos humanos, básicamente por medio de la observación, selección, propagación y conservación de las plantas que mejor cubrían sus necesidades. En la actualidad, se ha hecho necesario generar un sistema de protección de los derechos de quienes obtienen nuevas variedades vegetales, debido a la alta inversión económica que supone el sostener un programa de fitomejoramiento. El presente estudio busca dar a entender cómo se ha producido el cambio desde la gestación de variedades vegetales públicas a protegidas en Chile. Para ello, se revisa la historia del mejoramiento genético vegetal y sus efectos en la agricultura chilena. Sumado a esto, se analizan aquellos tratados internacionales vigentes que permiten otorgar derechos de propiedad intelectual sobre material vegetal y aquellos que pretenden regular el acceso y uso de recursos genéticos vegetales. Finalmente, se revisan la situación actual de Chile referente a la adhesión a estos tratados internacionales y el marco regulatorio vigente que permite otorgar estos derechos a los obtentores vegetales.

Plant breeding is a discipline that seeks to obtain new, desirable plant varieties. These varieties have specific traits whose purpose is solving some agricultural and commercial issues. This discipline is founded in species domestication, using techniques initiated more than 10,000 years ago in the first human settlements. This was done primarily through observation, selection, propagation and storage of the plants that best covered their needs. Today a formal system of legal protection is needed for those who develop new plant varieties due to the high financial investment required to sustain a targeted breeding program. This study seeks to show how changes have taken place in Chile over time, moving from public to protected plant varieties. The history of plant breeding and its effects on Chilean agriculture are reviewed in this investigation. Additionally, international treaties that seek to regulate access and use of vegetal genetic resources and those that grant intellectual property rights to vegetal material are analyzed. Lastly, the current reality in Chile regarding adherence to international treaties and the regulatory framework that allows granting of these rights to plant breeders are reviewed.
