Abstract
dc.description.abstract

Abstract
dc.description.abstract
The paper presents a general characterization of the different sorts of so
called “after-the-fact” liability recognized by the Chilean Penal Code,
grounded upon its understanding as a form of dependent, yet non-accessory,
intervention in a criminal offense. Upon this basis, the specificity of so
called “habitual personal favoring”, defined in its Art. 17 No. 4, is analyzed,
the particulars of which are insufficient for reversing its categorization
as an “after-the-fact” dependent mode of intervention. Special attention
is paid to the internal connection that holds between the requirement of
“habitualness” that needs to be satisfied by the favoring-behavior and the
modification operated on the general requirement of mens rea. The paper
closes with an inquiry into the consequences the thus presented account has
for the application of the statute of limitations.
