Propiedad intelectual en las variedades vegetales: las semillas y su futuro

Abstract

La Unión Internacional para la Protección de Obtenciones Vegetales es un Organismo Intergubernamental localizado en Suiza, que fomenta y promueve un Derecho de Propiedad Intelectual para los obtentores de nuevas Variedades Vegetales. Su relevante connotación en el Comercio Internacional se basa en el estimulo a la inversión, innovación, descubrimiento y mejoras de variedades, con el propósito de fomentar el fitomejoramiento con miras alimenticias, productivas y comerciales. Su vínculo directo con la OMC se da a través de los ADPIC al salvaguardar este derecho de Propiedad Intelectual. En el contexto actual chileno, es inminente la adaptación del acta UPOV 91, dado a compromisos contractuales existentes con los TLC; como el de Estados Unidos y el intercambio comercial con Europa y Asia quienes además norman bajo dicho acuerdo. Por la relevancia, connotación y contraste del tema se realiza un estudio de Caso titulado “Propiedad Intelectual en Variedades Vegetales. Las semillas y su futuro”. Basado en un análisis comparativo del estatuto jurídico del UPOV 78 vs UPOV 91 a través de cuatro grandes ámbitos, definición, el obtentor, el derecho mismo y las observancias de los acuerdos, se pretende enlistar las diferencias y conceder al lector un acercamiento objetivo para generarse así una opinión y conclusión propia. La adecuación del Acta 91 a las leyes internas de Chile y la coyuntura, permite recomendar que es momento oportuno para que Chile haga frente a sus compromisos internacionales y a la vez robustezca sus leyes para salvaguardar y proteger patrimonio histórico vegetal producto de variedades endémicas, propias de una cultura y tradición de un pueblo originario; a través de herramientas como denominación de origen, respaldado por un derecho consuetudinario y otras, que el sistema permite; con lo que le será posible afrontar ambas caras de compromisos sosteniendo una política responsable de apertura e integración comercial.

The International Union for the Protection of new Variety of Plants is an intergovernmental organization located in Switzerland, which to provide and promote an Intellectual Property Right for breeders of new plant varieties. Its important connotation in international trade is based on the stimulation of investment, innovation, discovery and improvement of varieties, in order to encourage the phyto-improvement of the breeding towards food, production and trade. It’s direct link with the WTO is through VTRIPS to safeguard this Intellectual Property Right. In the Chilean current context it’s imminent the adaptation of the act UPOV 91, due to existing contractual commitments with the FTA, as the United States and the trade with Europe and Asia who also are ruled under that agreement. For relevance, connotation and contrast of the subject a study of the case is being realized, entitled "Intellectual Property Plant Varieties. The seeds and their future." Based on a comparative analysis of the legal status of the UPOV 78 vs. UPOV 91 through four major scope; definition, the breeder, the law itself and the observance of the agreements. It’s intended to enlist the differences and give the reader an objective approach to generate an opinion and an own conclusion. The adequacy of Act 91 to the internal laws of Chile and the joint, allows to recommend that it is right time for Chile to meet its international commitments and ath the same time make teir laws stronger to safeguard and protect heritage vegetable varieties product of their endemic varieties, typical of a culture and tradition of the aboriginal chilean people, through tools such as designation of origin, supported by a common law and others, that the system allows, with what will be possible to comfront both sides of commitments holding a responsible policy of openness and commercial integration.
