Eliminación de registros, efectos en los impuestos finales

Abstract
La presente investigación y análisis se enfoca en el mensaje presidencial 107-366 denominado modernización tributaria publicado el 23 de agosto del 2018, donde uno de los cambios que el gobierno propone para ciertas empresas, es que con el objetivo de facilitar el cumplimiento tributario y concentrar los esfuerzos de los contribuyentes en generar negocios y no en obligaciones tributarias, se simplifican los registros tributarios y se libera de la obligación de llevarlos en la medida que no sea estrictamente necesario.
La problemática que se analizaremos es de que efectivamente no habría necesidad de mantener el control de todas las utilidades y/o cantidades afectas a los Impuestos finales, en diversos registros tributarios, para ello se analiza desde que comienza la ley de la renta en 1924 hasta la última reforma establecida en la ley 20.899 del 08 de febrero del 2016, la necesidad de tener registros para controlar las partidas con la tributación postergada en impuestos finales, también con el traspaso de registros en reorganizaciones empresariales.
Como conclusión se establece que cualquier retiro o distribución de dividendo estará afecto a IGC o IA y llevando consigo algún tipo de crédito. En el caso del REX, como su naturaleza es no asociar el derecho al crédito por impuestos de primera categoría (ya que en términos generales no existiría obligación de incorporar estas cantidades a los impuestos finales), la propuesta lo califica como causal de exclusión de la franquicia, existiendo por lo tanto la posibilidad de no controlar todas las utilidades en diversos registros. Finalmente, al analizar el fin de los registros, hay que considerar que es imperioso el control de los créditos y las cantidades del REX, debido a que todo lo demás en caso de ser retirado o remesado, podría tener derecho al crédito por impuestos de primera categoría, de aquí se desprende un cambio de paradigma donde al igual que en el registro FUT se procuraba controlar la “parte” que consistía en las rentas pendientes de tributación con los impuestos finales, en este caso solo se deberían controlar las rentas no afectas o exentas de impuestos finales, contenidas en el registro REX, ya que todo lo demás estaría afecto a tributación, creando así una simplificación verdadera donde existiría solo un REX y un SAC.
Finalmente, y a modo de sugerencia se sugiere un “Régimen de emprendimiento, simplificación, capitalización, fomento al ahorro y reinversión”
