La maternidad como elemento clave en el estudio y protección de la igualdad de género a nivel internacional

Abstract

La maternidad ha sido históricamente el fundamento para la asignación de roles de cuidado y labores del hogar a la mujer, construyendo a partir de este evento toda una estructura social donde se perpetúan las dinámicas de poder centradas en el rol del hombre proveedor y la mujer madre. El presente trabajo busca analizar el tratamiento otorgado por organismos internacionales al rol materno y la construcción legislativa a nivel internacional respecto a la igualdad de género. Además, se agregará brevemente al análisis la situación de Chile y cómo se ha adecuado a los estándares internacionales en la materia. Asimismo, se repasarán los alcances que tiene el género en la construcción doctrinaria y jurisprudencial del derecho a la igualdad y no discriminación, a fin de determinar la tendencia actual de las cortes internacionales de derechos humanos en torno a la aplicación de la perspectiva de género.

Motherhood has historically been the foundation for the assignment of care roles and household tasks to women, building upon this event an entire social structure where power dynamics centered on the role of the provider man and the mother woman are perpetuated. The present work seeks to analyze the treatment given by international organizations to the maternal role and the legislative construction at the internationa level regarding gender equality. In addition, the situation in Chile and how it has been adapted to international standards in this area will be briefly added to the analysis. Likewise, the scope of gender in the doctrinal and jurisprudential construction of the right to equality and non-discrimination will be reviewed, in order to determine the current trend of the international human rights courts regarding the application of the gender perspective.
