Barriers to foreign participation in the public procurement market is an issue that has been the subject of constant concern in the context of international trade, representing a substantial part of the gross domestic product in all countries of the world (between 10% and 15% of the world GDP), with the State being the largest purchaser of goods and services in the economy. In the case of Chile, since the government began to implement its public procurement model in 2003, it has made several modifications to its regulations, which it has considered indispensable for the development of this economic activity, having been recognized and awarded both nationally and internationally by multilateral organizations. Furthermore, it has been a pioneer in the inclusion of Public Procurement Agreements in its Free Trade Agreements, having signed 15 chapters to date, all of them guaranteeing national treatment, non-discrimination, and transparency, which are the fundamental pillars of such agreements. However, despite the modernization process of the public procurement market in Chile and the increase of foreign participation in this market, especially between the years 2008 to 2018, it is considered that barriers to the participation of foreign companies remain. Based on this hypothesis, this research has the general objective to identify which are the barriers for the participation of foreign companies in the Chilean Public Procurement market at present. To develop this analysis, in the first chapter, the modernization process of the public procurement market in Chile is examined, followed by an examination of foreign participation, in the second chapter, and a subsequent analysis of the barriers to foreign participation, including a study of the perception of foreign companies, in the third chapter.
